By using the Service, you represent and warrant that you have read and understood these Terms and agree to comply with them. If you do not agree to these Terms, you may not access or use the Service.
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Service or by sending you an email notification. Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the new Terms.
Eligibility: You must be at least 18 years old and capable of entering into a binding contract to use the Service.
Account Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate and complete.
Account Security: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify XTask immediately of any unauthorized use of your account.
Social Media Connections: By connecting social media accounts (e.g., Facebook, Instagram, Twitter) to XTask, you grant us permission to access, manage, and publish content on your behalf, consistent with the permissions you grant and our Privacy Policy. You agree to abide by the terms and policies of those third-party platforms.
Ownership: You retain all ownership rights to the content, including text, images, videos, and links, that you create, upload, schedule, or publish through the Service ("Your Content").
License: By submitting Your Content, you grant XTask a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute Your Content solely as necessary to provide the Service (e.g., to post it on your connected social media channels).
Warranties: You warrant that Your Content is original, that you own or have the necessary rights and permissions to use and authorize XTask to use Your Content as contemplated by the Service and these Terms, and that Your Content does not violate any third-party rights (including copyright, trademark, and privacy rights).
You agree not to use the Service to:
Upload, post, or publish content that is illegal, defamatory, obscene, pornographic, violent, hateful, or discriminatory.
Engage in spamming, fraudulent, or deceptive activity, including using the platform for unsolicited advertising or promotion.
Violate any applicable law, regulation, or third-party agreement, including the terms of service of any connected social media platform.
Interfere with or disrupt the integrity or performance of the Service.
Attempt to gain unauthorized access to the Service or its related systems or networks.
XTask provides AI-powered tools for content creation and suggestions.
AI Output: Content generated by our AI tools ("AI Output") is derived from algorithms. While you are solely responsible for the final publication of AI Output, XTask makes no warranty regarding the accuracy, completeness, or non-infringement of the AI Output.
Ownership: Subject to these Terms, you are the owner of the AI Output generated under your account.
Indemnity: You agree to indemnify XTask against any claims arising from your use or publication of any AI Output, including claims related to copyright infringement or defamation.
Pricing: Access to certain features of the Service requires payment of subscription fees, as outlined on the XTask pricing page.
Billing: Fees are billed in advance on a recurring, periodic basis (e.g., monthly or annual).
Cancellation and Refunds: You may cancel your subscription at any time. Cancellations will be effective at the end of the current billing cycle. XTask does not offer refunds for any partial subscription period already used, unless required by law.
Price Changes: XTask reserves the right to change the fees for the Service upon 30 days' notice.
Service Ownership: The Service, including all software, code, algorithms, design, and content (excluding Your Content and third-party content), is the sole property of XTask and is protected by copyright, trademark, and other intellectual property laws.
Limited License: XTask grants you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for your internal business or personal use, subject to these Terms.
By You: You may stop using the Service and terminate your account at any time.
By XTask: We may terminate or suspend your account access immediately, without prior notice or liability, if you breach these Terms (especially Section 4.2) or if your conduct harms XTask or others.
Effect of Termination: Upon termination, your right to use the Service will immediately cease. All accrued payment obligations and sections related to ownership, intellectual property, disclaimers, indemnity, and limitation of liability shall survive termination.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. XTask makes no warranties, expressed or implied, regarding the Service, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. XTask does not warrant that the Service will be uninterrupted, error-free, or completely secure.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL XTASK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (iii) ANY CONTENT OBTAINED FROM THE SERVICE, INCLUDING AI OUTPUT; AND (iv) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR TRANSMISSIONS.
IN NO EVENT SHALL XTASK'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO XTASK DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
You agree to defend, indemnify, and hold harmless XTask and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with: (i) your access to or use of the Service; (ii) Your Content; or (iii) your violation of these Terms.
These Terms shall be governed by the laws of [Insert your Governing Jurisdiction, e.g., the State of California or country where your business is legally registered], without regard to its conflict of law provisions.
